Work with a Lockport workers’ compensation lawyer who guides you through the process.
The workers’ compensation system in New York is designed to help employees obtain benefits when they are injured or develop an illness during their employment. Workers’ compensation is a no-fault system, meaning workers can obtain benefits even if they caused or contributed to the accident. Filing a workers’ compensation claim is not always easy, particularly if your employer or their insurance company disputes your claim. Our Lockport workers’ compensation lawyer can help you protect your rights after a workplace injury.
Report the Injury
If you become ill or sustain an on-the-job injury, it is critical to notify your employer within 30 days. Notifying your employer in writing will create a record that you reported the injury and that you reported it on time. The notice includes a brief description of what happened, when and where you were injured, the employment task you were completing at the time, and who you told about the incident.
Seek Medical Treatment
It is essential that you seek medical treatment to prevent your injuries from worsening and to protect your well-being. If urgent care is necessary, visit an emergency room as soon as possible. For any further treatment, it is important to use the New York Workers’ Compensation Board search tool. The Board generally expects employees to use a provider authorized by the Board.
During your visit, tell the doctor that the injury occurred at work and that you work for whom. Ask for written visit summaries, written work restrictions, and any referrals. This documentation can help if the insurance company asks for clarification in the future.
File Form C-3
You must then file Form C-3, which notifies the Board of your claim. You can file this form online or print it and mail it. You can also submit it in person to the nearest Board office. It is important to make a copy before submitting it to the Board. You will need the following details when filing Form C-3:
- The name and address of your employer
- The date and location of the injury, or the date you started noticing symptoms
- The employment duties you were fulfilling at the time of the accident and the injuries you sustained
- Your pay schedule and wage information
- The date you first received medical treatment for your injuries
File Form C-3 within two years of your injury to keep your benefits eligibility.
